1. Agreement
These Product Terms govern your use of the PharmStack platform and services ("Service").
By using PharmStack (including any trial or paid subscription), you agree to these terms.
If you are using PharmStack on behalf of a pharmacy or organisation, you confirm you are authorised to bind that entity to these terms.
2. The Service
PharmStack provides a web-based platform for:
- accessing pharmacy documents and SOPs;
- generating AI-assisted responses based on those documents;
- managing internal resources, announcements, and workflows; and
- optional features such as tasks, calendar, and special orders.
We may update or improve the Service from time to time.
3. Your responsibilities
You agree to:
- use the Service in accordance with applicable laws and regulations;
- ensure staff use the system appropriately;
- verify outputs before relying on them in practice; and
- maintain the accuracy and appropriateness of your documents and content.
You remain responsible for all decisions made using the Service.
4. Your data and content
You retain ownership of all content you upload ("Your Content").
You grant us a limited licence to store, process, display, and use Your Content as necessary to provide the Service.
You confirm that:
- you have the right to upload and use Your Content;
- it does not infringe third-party rights; and
- it does not contain unlawful material.
5. AI-generated responses
PharmStack generates responses using your pharmacy's documents and configured workflows.
In some cases, the system may assist with questions using general reasoning where information is not available in your documents.
You acknowledge that:
- outputs may not always be complete or accurate;
- responses should be reviewed by qualified staff; and
- PharmStack does not replace professional judgement.
The Service may prompt users to verify information or escalate to a pharmacist where appropriate.
6. Data handling
We handle data in accordance with our Privacy Policy. In summary:
- customer pharmacy data is primarily hosted in Sydney-region cloud infrastructure, with application processing also configured to run in Sydney, though limited overseas processing by service providers may occur;
- document AI processing uses Standard Azure OpenAI deployments in Australia East; limited authentication, website email, support, monitoring or messaging information may be processed overseas by service providers and their subprocessors;
- customer notifications (e.g. SMS) are sent via ClickSend using the recipient mobile number and message content selected by the pharmacy, which may include health-related information; and
- your data is not used to train public or shared AI models.
7. Availability
We aim to keep the Service available at all times, but do not guarantee uninterrupted access.
The Service may be unavailable due to:
- maintenance;
- technical issues; or
- third-party dependencies.
8. Fees and billing
Where applicable:
- pricing is per store, per month;
- fees are billed in advance unless agreed otherwise;
- add-ons are billed separately; and
- we may update pricing with reasonable notice.
9. Cancellation
You may cancel your subscription at any time.
Access will continue until the end of the current billing period unless otherwise agreed.
10. Acceptable use
You must not:
- use the Service for unlawful purposes;
- upload content you are not authorised to use;
- attempt to interfere with or disrupt the Service; or
- misuse AI functionality or attempt to generate harmful outputs.
11. Limitation of liability
To the extent permitted by Australian law:
- PharmStack is not liable for indirect or consequential loss;
- including loss of profits, data, or business interruption; and
- where liability cannot be excluded, it is limited to the amount paid by you for the Service in the preceding 3 months.
12. Indemnity
You agree to indemnify PharmStack against claims arising from:
- your use of the Service;
- your content; or
- your breach of these terms,
except where caused by our gross negligence or wilful misconduct.
13. Termination
We may suspend or terminate access if:
- these terms are breached; or
- use of the Service creates risk or harm.
14. Governing law
These terms are governed by the laws of Australia.
